2. Eligibility and acceptance
You must be at least 18 years old and legally able to enter into a contract to place an order or create an account.
By placing an order, starting a subscription or using our services, you agree to these terms and our Privacy Policy. If you order for a business or organisation, you confirm that you have authority to act for it.
3. Our products and services
TapUpCard may provide:
- TapUp Review: NFC and QR review cards configured to direct customers to the review destination selected for your business;
- TapUp Connect: NFC and QR business cards linked to an editable digital profile;
- TapUp AI: Early Access subscription-based tools intended to help generate and manage replies to customer reviews, subject to availability and production integration; and
- related account, analytics, support and fulfilment services.
Product images are illustrative. Colours, finishes and appearance may vary slightly between screens and manufactured items.
NFC operation depends on the device, its settings and compatibility. QR functionality requires a working camera and internet connection.
4. Orders and contracts
Please check all information before paying. Your order is an offer to purchase. A contract is formed when we confirm acceptance or confirm successful payment and begin processing the order.
We may reject or cancel an order where a product is unavailable, information is incorrect, payment is not authorised, fraud is suspected or fulfilling the order would be unlawful. If payment has already been taken, we will refund the affected amount.
You are responsible for supplying complete and accurate delivery, profile, business and configuration information.
5. Prices and payment
Prices are displayed in pounds sterling unless stated otherwise. TapUpCard is not currently VAT registered, so VAT is not separately charged. Delivery charges and other applicable costs will be shown before payment where relevant.
Payments are handled by Mollie or another displayed payment provider. You authorise the payment provider to process the amount shown at checkout.
We may correct an obvious pricing error before accepting an order. If this happens, we will give you the option to proceed at the correct price or receive a refund.
6. Delivery
Available destinations, estimated delivery times and charges are shown during ordering or communicated before dispatch. Unless otherwise agreed, consumer orders will be delivered without undue delay and normally within 30 days.
Delivery estimates are not guaranteed dates. Please contact us if an order is delayed. Risk in physical goods passes to a consumer when the goods are delivered to the consumer or a person they identify.
For deliveries outside the United Kingdom, the recipient is responsible for any import duties, customs charges or local taxes unless checkout expressly states that they are included. Customs processing may cause delays outside our control.
7. Cancellations, returns and refunds
Standard TapUp Connect cards
If you are a consumer, you normally have 14 days after receiving a standard, non-personalised TapUp Connect card to tell us that you wish to cancel. You then normally have a further 14 days to return it.
You are normally responsible for return postage unless the product is faulty or we supplied the wrong item. We may make a lawful deduction if handling beyond what would be permitted in a shop reduces the product’s value.
Configured or personalised physical products
The statutory change-of-mind cancellation right does not normally apply to goods made to your specification or clearly personalised. Where a TapUpCard product is made or configured specifically for your order, cancellation may no longer be possible once production or configuration has started.
Contact us immediately if you need to change or cancel an order. We will help where reasonably possible but cannot guarantee changes after fulfilment work has begun.
TapUp AI subscriptions
A consumer normally has 14 days from entering a service contract to cancel. If you ask us to begin providing the service during this period, we may charge a proportionate amount for service supplied before cancellation where the law permits.
After the initial cancellation period, you may cancel a recurring subscription before its next renewal. Cancellation stops future renewals and normally takes effect at the end of the period already paid for. Amounts for a period already started are not refundable unless required by law or expressly agreed.
Faulty or misdescribed products
Nothing in these terms limits your legal rights concerning goods or services that are faulty, damaged, not as described or not provided with reasonable care and skill.
To request a cancellation, return or refund, email info@tapupcard.com with your name, order number and request.
8. Accounts and security
You must provide accurate account information, protect your login details and tell us promptly about suspected unauthorised access. You are responsible for activity carried out through your account unless caused by our failure to use reasonable care.
We may suspend access where reasonably necessary to protect users, investigate misuse, comply with law or secure the service.
9. Digital profiles and acceptable use
You retain ownership of content you submit. You give us a non-exclusive licence to host, reproduce and display that content only as needed to operate the requested service.
You must not use TapUpCard to:
- break the law, mislead people or impersonate another person;
- publish content that is unlawful, infringing, malicious, abusive or discriminatory;
- collect or disclose personal information without an appropriate legal basis;
- interfere with security or attempt unauthorised access;
- send spam or manipulate reviews, ratings or platform systems; or
- upload malware or content that harms TapUpCard or another person.
We may remove unlawful or harmful content and may suspend or terminate serious or repeated misuse.
10. TapUp AI, approvals and automation
AI-generated replies may be incomplete, inaccurate or inappropriate. TapUpCard does not guarantee that generated content will achieve a particular rating, customer response or business result.
AI Starter
AI Starter is designed around manual approval. Generated replies remain available for you to review, edit, approve or skip before publication.
AI Auto
AI Auto may publish or process selected replies automatically according to the rules and settings you configure. You are responsible for choosing appropriate automation rules, monitoring the service and using manual approval where a review is sensitive or requires personal attention.
You remain responsible for the business use of AI-generated content and for complying with the rules of connected third-party platforms.
Google and other third-party services have their own terms, policies, availability and technical requirements. Third-party changes, restrictions or outages may affect connected features.
TapUpCard is not responsible for reviews written by third parties and cannot guarantee that Google or another platform will publish, retain or remove particular content.
11. Subscriptions and recurring payments
TapUp AI plans are recurring subscriptions unless stated otherwise. TapUp AI is currently offered in Early Access and is not fully available until the required Google Business Profile production integration is ready. The subscription price, one-time setup fee and billing frequency are shown before you subscribe, and any service start remains subject to availability.
By starting a recurring subscription, you authorise the payment provider to collect future subscription payments until you cancel.
If a recurring payment fails, we may retry payment, ask you to update your payment method, restrict paid features or suspend the subscription until payment is resolved.
12. Intellectual property
TapUpCard’s website, software, branding, designs and original materials belong to us or our licensors and are protected by intellectual property law.
We give you a limited, revocable, non-transferable right to use the service for its intended purpose while your account or subscription remains active. You may not copy, resell, reverse engineer or commercially exploit the service except where law expressly permits it.
13. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. Maintenance, security work and events outside our reasonable control may affect access.
We may improve, replace or discontinue features. If a material change significantly reduces a paid service during its current paid period, we will provide an appropriate remedy where required.
14. Liability
Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or your mandatory consumer rights.
If you are a consumer, we are responsible for foreseeable loss caused by our breach of these terms or failure to use reasonable care. We are not responsible for business losses where you purchased as a consumer.
If you purchase for business purposes, neither party is liable for indirect or consequential loss, loss of profit, revenue, goodwill or anticipated savings, except where such liability cannot legally be limited. Subject to those exceptions, our total liability relating to a claim will not exceed the amount you paid for the affected product or, for a subscription claim, the amount paid during the preceding 12 months.
15. Ending service access
You may stop using the service at any time and may request account closure by contacting us. Subscription cancellation is governed by section 7.
We may end or suspend service access for serious breach, non-payment, unlawful activity, security risk or where continuing the service is no longer reasonably possible. Where appropriate, we will provide notice and an opportunity to correct the issue.
16. Privacy
Our Privacy Policy explains how we collect and use personal information.
17. Changes to these terms
We may update these terms to reflect changes in law, our services or business operations. Updated terms will be published here. Material changes affecting an active paid service will be communicated where reasonably required.
18. Governing law
These terms are governed by the laws of England and Wales. Courts in England and Wales will have jurisdiction, but consumers living elsewhere retain any mandatory rights and may be entitled to bring proceedings in their home courts.
